TENDER DESCRIPTION

As a federal enterprise, GIZ primarily works for the Federal Government and receives contracts from the federal ministries based on the principles for “in-house” procurement developed by the European Court of Justice. This means that the Federal Government commissions GIZ directly, without having to itself issue a call for tenders for this commissioning. GIZ, in turn, is a contracting authority within the meaning of Section 99 No. 2 of the Act against Restraints of Competition (GWB) and, as such, is obliged to comply with procurement law. When commissioning third parties within the European economic area, GIZ therefore has to apply the applicable procurement and contract regulations for services or for construction services (VgV, VOB), if the thresholds set out in EU Regulation 2021/1952 are exceeded. Below these threshold values, GIZ is obliged, on the basis of a special agreement with the Federal Ministry for Economic Cooperation and Development (BMZ), to comply with the UVgO when implementing federal contracts.
