TENDER DESCRIPTION

As a federal entity, GIZ is primarily active for the Federal Government and receives contracts from the federal ministries on the basis of the principles for “in-house” procurement developed by the European Court of Justice. This means that the Federal Government commissions GIZ directly without having to issue the commissioning itself. GIZ, in turn, is a contracting authority within the meaning of Section 99(2) of the Act against Restraints of Competition (Gesetz gegen Wettbewerbsbeschränkungen, GWB) and, as such, is obliged to comply with procurement law. Consequently, when commissioning third parties within the European economic area, GIZ must apply the applicable procurement and contract rules for services or for construction work (VgV, VOB) if the thresholds set out in EU Regulation 2021/1952 are exceeded. Below these thresholds, GIZ—due to a special agreement with the BMZ—is obliged to comply with the UVgO when implementing federal contracts.
