DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the non-discriminatory access opportunity for all pharmaceutical companies. It shall end automatically regardless upon the entry into force of the exclusivity contract for the active ingredient Abatacept, ATC L04AA24, following a formal procurement procedure in accordance with the regulations of Part 4 of the GWB with one or more contracting partners. To reflect the diversity of potential contracting partners within the framework of the approval model, every pharmaceutical company is enabled to conclude a framework contract at any time during the contract term under the same conditions. The required contractual documents are available for download via the online portal www.dtvp.de/center under the link specified in section 5.1.11.
