DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies. Nevertheless, it will automatically end with the entry into force of the exclusive contract for the active substance Abatacept, ATC L04AA24, following a formal procurement procedure under the rules of Part 4 of the GWB with one or more contracting parties. To accommodate the variety of potential contracting parties within the approval model framework, each pharmaceutical company is allowed to conclude a framework agreement at any time during the contract term and under the same conditions. The necessary contract documents are available for download via the online portal www.dtvp.de/center under the link specified in 5.1.11.
