DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the lack of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies. Regardless, it ends automatically with the entry into force of the exclusive contract for the active ingredient allergen extract from exclusively meadow foxtail pollen, ATC V01AA02, following a formal procurement procedure according to the regulations of Part 4 of the GWB with one or more contracting partners. To do justice to the diversity of potential contracting partners under the approval model, every pharmaceutical company is enabled at any time during the contract period to enter into a framework agreement under the same conditions.
