DAK-Gesundheit assumes that this procedure, due to the absence of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies, does not fall within the scope of cartel procurement law. It will end automatically regardless of this with the entry into force of the exclusive contract for the active ingredient allergen extract from exclusively meadow timothy grass pollen, ATC V01AA02, following a formal procurement procedure under the regulations of Part 4 of the GWB with one or more contracting parties. To accommodate the diversity of potential contracting partners within the approval model, each pharmaceutical company is enabled at any time during the contract term to conclude a framework agreement under the same conditions.
