DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies. It ends automatically regardless upon the entry into force of the exclusive contract for the active ingredient allergen extract from meadow fescue, ryegrass, bobble grass, timothy grass, and orchard grass pollen, ATC V01AA02, as a result of a formal procurement procedure according to the regulations of Part 4 of the GWB with one or more contracting partners. To do justice to the diversity of potential contracting partners within the approval model, each pharmaceutical company is enabled to conclude a framework agreement at any time and on the same conditions during the term of the contract.
