DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies. It ends automatically regardless upon the entry into force of the exclusive contract for the active ingredient allergen extract from meadow sweet grass, couch grass, meadow foxtail, ryegrass, and timothy grass pollen, ATC V01AA02, following a formal procurement procedure according to the regulations of the 4th part of the GWB with one or more contracting partners. To do justice to the diversity of potential contracting partners within the framework of the approval model, every pharmaceutical company is enabled to conclude a framework contract at any time and on the same conditions during the contract term.
