TENDER DESCRIPTION

DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel tender law due to the absence of a selection decision and thus due to the non-discriminatory access possibility for all pharmaceutical companies. Regardless of this, it ends automatically upon entry into force of the exclusive agreement for the active ingredient Apixaban, ATC B01AF02, as a result of a formal tender procedure in accordance with the rules of Part 4 of the GWB with one or more contracting parties. In order to accommodate the diversity of potential contracting parties under the approval model, during the term of the contract, each pharmaceutical company is given the opportunity at any time to conclude a framework agreement under the same conditions.
