TENDER DESCRIPTION

DAK-Gesundheit assumes that this procedure, due to the absence of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies, does not fall within the scope of cartel procurement law. It will automatically terminate regardless upon the entry into force of the exclusive contract for the active ingredient Baclofen (excluding oral dosage form), ATC M03BX01, as a result of a formal procurement procedure according to the regulations of Part 4 of the GWB with one or more contracting partners. To do justice to the variety of potential contracting partners within the framework of the approval model, each pharmaceutical company is allowed to conclude a framework agreement at any time during the contract period and under the same conditions.
