DAK-Gesundheit assumes that this procedure, due to the absence of a selection decision and thus nondiscriminatory access for all pharmaceutical companies, does not fall within the scope of cartel procurement law. Regardless, it automatically ends with the entry into force of the exclusive agreement for the active ingredient Betamethasone + Clotrimazole, ATC D01AC20, following a formal procurement procedure according to the regulations of Part 4 of the GWB with one or more contracting partners. To accommodate the variety of potential contracting partners within the approval model, every pharmaceutical company is enabled to conclude a framework agreement at any time during the contract term and under the same conditions.
