DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the non-discriminatory access opportunity for all pharmaceutical companies. It ends automatically regardless upon the entry into force of the exclusive contract for the active substance Betamethasone + Clotrimazole, ATC D01AC20, following a formal procurement procedure in accordance with the regulations of Part 4 of the GWB with one or more contracting parties. To do justice to the diversity of potential contracting parties within the framework of the approval model, every pharmaceutical company is enabled to conclude a framework contract at any time during the contract period and under the same conditions.
