TENDER DESCRIPTION

DAK-Gesundheit assumes that this procedure, due to the lack of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies, does not fall within the scope of cartel procurement law. It ends automatically regardless with the entry into force of the exclusivity agreement for the active ingredient Bimekizumab, ATC L04AC21, following a formal procurement procedure in accordance with the regulations of Part 4 of the GWB with one or more contracting partners. To accommodate the diversity of potential contracting partners within the approval model, the conclusion of a framework agreement is made possible at any time and under the same conditions for each pharmaceutical company during the contract term.
