DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies. It ends automatically regardless upon the entry into force of the exclusive contract for the active ingredient Bimekizumab, ATC L04AC21, following a formal procurement procedure according to the regulations of Part 4 of the GWB with one or more contracting partners. To accommodate the variety of potential contracting partners under the approval model, each pharmaceutical company is allowed to conclude a framework agreement at any time and under the same conditions during the contract period.
