TENDER DESCRIPTION

DAK-Gesundheit assumes that this procedure, due to the absence of a selection decision and thus the non-discriminatory access opportunity for all pharmaceutical companies, does not fall within the scope of cartel procurement law. It will end automatically and independently upon entry into force of the exclusive contract for the active substance Biperiden (exclusively strength 4mg), ATC N04AA02, following a formal procurement procedure under the regulations of Part 4 of the GWB with one or more contracting partners. To accommodate the diversity of potential contracting partners within the approval model, each pharmaceutical company is enabled to conclude a framework agreement at any time during the contract term under the same conditions. The necessary contract documents are available for download via the online portal www.dtvp.de/center at the link specified under 5.1.11.
