DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and, thus, the non-discriminatory possibility for access for all pharmaceutical companies. It ends automatically and independently of this with the entry into force of the exclusive contract for the active ingredient Botulinumtoxin type A (exclusively Abobotulinum), ATC M03AX21, as a result of a formal procurement procedure in accordance with the regulations of Part 4 of the GWB with one or more contracting parties. In order to do justice to the diversity of potential contracting parties within the framework of the approval model, each pharmaceutical company is given, at any time during the term of the contract, the possibility to conclude a framework agreement under the same conditions.
