DAK-Gesundheit assumes that, due to the absence of a selection decision and hence due to the possibility of non-discriminatory access for all pharmaceutical companies, this procedure does not fall within the scope of cartel procurement law. Regardless of this, it ends automatically upon the entry into force of the exclusive contract for the active substance Botulinum toxin type A (exclusively abobotulinum), ATC M03AX21, as a result of a formal procurement procedure in accordance with the rules of Part 4 of the GWB with one or more contract partners. In order to give due consideration to the diversity of potential contract partners within the framework of the approval model, during the term of the contract each pharmaceutical company is offered the possibility to conclude a framework agreement at any time under the same conditions.
