DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and, accordingly, the non-discriminatory access possibility for all pharmaceutical companies. Regardless of this, it ends automatically upon entry into force of the exclusive contract for the active ingredient botulinum toxin type A (exclusively incobotulinum), ATC M03AX21, following a formal procurement procedure in accordance with the provisions of Part 4 of the GWB with one or more contracting parties. In order to accommodate the diversity of potential contracting parties under the approval model, each pharmaceutical company will be allowed during the term of the contract to conclude a framework contract at any time and under the same conditions.
