TENDER DESCRIPTION

DAK-Gesundheit assumes that, due to the absence of a selection decision and thus the non-discriminatory access option for all pharmaceutical companies, this procedure does not fall within the scope of cartel procurement law. It ends automatically irrespective of anything else upon the entry into force of the exclusive contract for the active ingredient botulinum toxin type A (exclusively Onabotulinum), ATC M03AX21, as a result of a formal procurement procedure in accordance with the rules of Part 4 of the GWB with one or more contract partners. To do justice to the diversity of potential contract partners within the framework of the approval model, each pharmaceutical company is enabled at any time during the term of the contract to conclude a framework contract on the same terms.
