TENDER DESCRIPTION

DAK-Gesundheit assumes that this procedure, due to the absence of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies, does not fall within the scope of cartel procurement law. It will automatically end regardless upon entry into force of the exclusive contract for the active ingredient Brimonidine (exclusively in single dose form), ATC S01EA05, following a formal procurement procedure in accordance with the regulations of Part 4 of the GWB with one or more contracting partners. To accommodate the diversity of potential contracting partners within the approval model, every pharmaceutical company is enabled to conclude a framework contract at any time during the contract term and under the same conditions.
