TENDER DESCRIPTION

DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies. It ends automatically regardless of this upon the coming into force of the exclusive contract for the active ingredient Brimonidine (exclusively in the single-dose presentation form), ATC S01EA05, as a result of a formal procurement procedure in accordance with the regulations of the 4th part of the GWB with one or more contracting partners. To do justice to the diversity of potential contracting partners under the approval model, each pharmaceutical company is enabled to conclude a framework agreement at any time during the contract period and under the same conditions.
