TENDER DESCRIPTION

DAK-Gesundheit assumes that this procedure, due to the absence of a selection decision and thus non-discriminatory access for all pharmaceutical companies, does not fall within the scope of the cartel procurement law. It ends automatically regardless upon the entry into force of the exclusive contract for the active substance Brinzolamide + Brimonidine, ATC S01EC24 as a result of a formal procurement procedure in accordance with the regulations of Part 4 of the GWB with one or more contracting partners. To do justice to the diversity of potential contracting partners within the framework of the approval model, each pharmaceutical company is enabled at any time during the contract period to conclude a framework agreement on the same conditions. The necessary contract documents for this are available for download via the online portal www.dtvp.de/center under the link named in point 5.1.11.
