TENDER DESCRIPTION

DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the discrimination-free access possibility for all pharmaceutical companies. It ends automatically regardless upon entry into force of the exclusive contract for the active substances Brinzolamide + Brimonidine, ATC S01EC24, as a result of a formal procurement process according to the regulations of Part 4 of the GWB with one or more contracting partners. To take account of the variety of potential contracting partners within the framework of the approval model, every pharmaceutical company is allowed to conclude a framework contract at any time during the contract period and under the same conditions. The required contract documents are available for download via the online portal www.dtvp.de/center under the link specified under 5.1.11.
