DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies. It ends automatically regardless with the entry into force of the exclusive contract for the active substance Brivaracetam, ATC N03AX23, as a result of a formal award procedure under the regulations of Part 4 of the GWB with one or more contracting partners. To do justice to the diversity of potential contracting partners within the framework of the approval model, every pharmaceutical company is enabled at any time during the contract term to conclude a framework agreement on the same conditions. The necessary contract documents are available for download via the online portal www.dtvp.de/center under the link specified in section 5.1.11.
