DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies. It will end automatically regardless upon the entry into force of the exclusive agreement for the active ingredient Brolucizumab, ATC S01LA06, following a formal procurement procedure pursuant to the regulations of Part 4 of the GWB with one or more contracting partners. To do justice to the diversity of potential contracting partners within the scope of the approval model, each pharmaceutical company is allowed to conclude a framework agreement at any time and under the same conditions during the term of the contract.
