DAK-Gesundheit assumes that this procedure, due to the absence of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies, does not fall within the scope of cartel procurement law. It ends automatically irrespective of this upon the entry into force of the exclusive contract for the active ingredient Budesonide and Formoterol (exclusively IHP in the strength 80 µg /4.5 µg), ATC R03AK07, as a result of a formal procurement procedure under the regulations of Part 4 of the GWB with one or more contracting partners. To do justice to the variety of potential contracting partners within the framework of the approval model, every pharmaceutical company is enabled at any time during the contract term to conclude a framework agreement on the same conditions.
