TENDER DESCRIPTION

DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies. It ends automatically regardless upon the entry into force of the exclusive contract for the active ingredient Capsaicin, ATC N01BX04, following a formal procurement procedure in accordance with the regulations of Part 4 of the GWB with one or more contracting partners. To do justice to the diversity of potential contracting partners within the framework of the approval model, every pharmaceutical company is allowed to conclude a framework agreement at any time and under the same conditions during the contract term. The necessary contractual documents are available for download via the online portal www.dtvp.de/center under the link given in section 5.1.11.
