TENDER DESCRIPTION

DAK-Gesundheit assumes that this procedure, due to the absence of a selection decision and thus non-discriminatory access for all pharmaceutical companies, does not fall within the scope of cartel procurement law. It ends automatically regardless with the commencement of the exclusive contract for the active ingredient Cefadroxil (exclusively dosage form TAB), ATC J01DB05, following a formal procurement procedure according to the regulations of Part 4 of the GWB with one or more contracting partners. To reflect the diversity of potential contracting partners within the framework of the approval model, every pharmaceutical company is enabled to conclude a framework agreement at any time during the contract term under the same conditions. The necessary contractual documents are available for download via the online portal www.dtvp.de/center at the link specified under section 5.1.11.
