TENDER DESCRIPTION

DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the non-discriminatory access opportunity for all pharmaceutical companies. It automatically ends regardless upon the entry into force of the exclusivity agreement for the active ingredient Cefixime (exclusively dosage form FTA), ATC J01DD08, following a formal procurement procedure under the regulations of Part 4 of the GWB with one or more contracting partners. To do justice to the variety of potential contracting partners within the approval model, every pharmaceutical company is enabled to conclude a framework agreement at any time and under the same conditions during the contract term. The necessary contractual documents are available for download via the online portal www.dtvp.de/center under the link specified in section 5.1.11.
