TENDER DESCRIPTION

DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and hence the non-discriminatory access possibility for all pharmaceutical companies. It ends automatically and independently in consequence of the entry into force of the exclusive contract for the active ingredient Cinacalcet (exclusively in the standard pack size N3), ATC H05BX01, following a formal procurement procedure in accordance with the rules of Part 4 of the GWB with one or more contracting parties. To do justice to the variety of potential contracting parties under the approval model, during the term of the contract the conclusion of a framework agreement is made possible at any time for every pharmaceutical company on the same terms.
