TENDER DESCRIPTION

DAK-Gesundheit assumes that, due to the absence of a selection decision and hence the non-discriminatory access option for all pharmaceutical companies, this procedure does not fall within the scope of cartel procurement law. It ends automatically and independently of this upon the entry into force of the exclusive contract for the active ingredient Cinacalcet (exclusively in standard pack size N3), ATC H05BX01, as a result of a formal tender procedure in accordance with the provisions of Part 4 of the GWB with one or more contracting parties. To ensure fairness with respect to the variety of potential contracting parties within the scope of the admission model, each pharmaceutical company is enabled at any time during the term of the contract to conclude a framework contract under the same conditions.
