TENDER DESCRIPTION

DAK-Gesundheit assumes that, due to the absence of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies, this procedure does not fall within the scope of cartel procurement law. Regardless, it ends automatically upon the entry into force of the exclusive contract for the active substance cladribine, ATC L04AA40, as a result of a formal procurement procedure in accordance with the regulations of Part 4 of the GWB with one or more contracting parties. In order to do justice to the diversity of potential contracting parties within the admission model, during the term of the contract each pharmaceutical company is enabled at any time to conclude a framework contract under the same conditions.
