TENDER DESCRIPTION

DAK-Gesundheit assumes that, due to a missing selection decision and thus the non-discriminatory possibility of access for all pharmaceutical companies, this procedure does not fall within the scope of cartel procurement law. It ends automatically and independently upon the entry into force of the exclusive contract for the active substance Cladribine, ATC L04AA40, as a result of a formal procurement procedure in accordance with the rules of Part 4 of the GWB with one or more contract partners. To do justice to the diversity of potential contract partners under the approval model, each pharmaceutical company will be allowed, at any time during the term of the contract, to conclude a framework agreement under the same conditions. The contract documents required for this are available for download via the online portal www.dtvp.de/center via the link specified in 5.1.11.
