TENDER DESCRIPTION

DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus due to the possibility of access without discrimination for all pharmaceutical companies. It ends automatically and independently with the entry into force of the exclusive contract for the active ingredient clomipramine, ATC N06AA04, as a result of a formal tender procedure in accordance with the provisions of Part 4 of the GWB with one or more contracting parties. In order to accommodate the variety of potential contracting parties under the approval model, each pharmaceutical company is granted, at any time during the contract term, the conclusion of a framework agreement under the same conditions.
