TENDER DESCRIPTION

DAK-Gesundheit assumes that, due to the absence of a selection decision and thus because all pharmaceutical companies have non-discriminatory access, this procedure does not fall within the scope of cartel procurement law. Regardless, it ends automatically upon the entry into force of the exclusive contract for the active ingredient Clomipramine, ATC N06AA04, as a result of a formal procurement procedure in accordance with the provisions of Part 4 of the GWB with one or more contracting parties. In order to do justice to the diversity of potential contracting parties within the framework of the approval model, the conclusion of a framework agreement with each pharmaceutical company will be enabled at any time during the term of the contract and on the same terms.
