TENDER DESCRIPTION

DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel tendering law due to the absence of a selection decision and thus due to the non-discriminatory access opportunity for all pharmaceutical companies. In any event, it ends automatically upon the entry into force of the exclusive contract for the active ingredient dihydrocodeine, ATC R05DA14, as a result of a formal tender procedure in accordance with the provisions of Part 4 of the GWB with one or more contracting parties. To take account of the diversity of potential contracting parties within the framework of the marketing authorisation model, each pharmaceutical company is enabled, at any time during the term of the contract, to conclude a framework agreement at any time and under the same conditions.
