TENDER DESCRIPTION

DAK-Gesundheit assumes that, due to the absence of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies, this procedure does not fall within the scope of cartel procurement law. It ends, irrespective of this, automatically upon entry into force of the exclusive contract for the active ingredient dihydrocodeine, ATC R05DA14, as a result of a formal procurement procedure in accordance with the rules of Part 4 of the GWB with one or more contracting parties. In order to do justice to the diversity of potential contracting parties within the approval model, each pharmaceutical company is enabled, at any time during the term of the contract, to conclude a framework agreement at any time and on the same terms.
