DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies. Regardless of this, it will automatically end upon the entry into force of the exclusive contract for the active ingredient dydrogesterone, ATC G03DB01, following a formal tender procedure under the regulations of Part 4 of the GWB with one or more contracting partners. To accommodate the diversity of potential contracting partners within the approval model, each pharmaceutical company will be allowed to conclude a framework contract at any time during the contract period and on the same conditions.
