TENDER DESCRIPTION

DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and, accordingly, the non-discriminatory access opportunity for all pharmaceutical companies. It ends automatically, regardless, with the entry into force of the exclusive contract for the active ingredient Elafibranor, ATC A05AX06, as a result of a formal procurement procedure in accordance with the rules of Part 4 of the GWB with one or more contracting parties. In order to accommodate the diversity of potential contracting parties within the framework of the approval model, each pharmaceutical company is allowed, at any time during the term of the contract, to conclude a framework agreement under the same conditions.
