DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel award law due to the absence of a selection decision and, therefore, due to the non-discriminatory possibility of access for all pharmaceutical companies. It ends automatically regardless of this with the entry into force of the exclusive agreement for the active ingredient Elafibranor, ATC A05AX06, as a result of a formal award procedure in accordance with the provisions of Part 4 of the GWB with one or more contracting parties. To do justice to the diversity of potential contracting parties within the framework of the marketing authorisation model, each pharmaceutical company is, throughout the term of the contract, able at any time to conclude a framework agreement for each contracting opportunity on the same terms and conditions.
