DAK-Gesundheit assumes that this procedure is not subject to cartel procurement law due to the lack of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies. Regardless of this, it automatically ends with the entry into force of the exclusive contract for the active substance Emtricitabine + Rilpivirine + Tenofovir disoproxil fumarate, ATC J05AR08, following a formal procurement procedure in accordance with the regulations of Part 4 of the GWB with one or more contracting partners. To accommodate the variety of potential contracting partners under the approval model, each pharmaceutical company is enabled to conclude a framework agreement at any time during the contract period and under the same conditions.
