DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the discrimination-free access possibility for all pharmaceutical companies. Regardless, it ends automatically with the entry into force of the exclusive contract for the active ingredient Emtricitabine + Rilpivirine + Tenofovir disoproxil fumarate, ATC J05AR08, following a formal procurement procedure according to the regulations of Part 4 of the GWB with one or more contracting partners. To accommodate the diversity of potential contracting partners within the approval model, every pharmaceutical company is enabled to conclude a framework agreement at any time and under the same conditions during the contract term.
