DAK-Gesundheit assumes that, due to the lack of an selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies, this procedure does not fall within the scope of cartel procurement law. It ends automatically and regardless thereof upon the entry into force of the exclusive contract for the active ingredient Ezetimib + Atorvastatin (excluding pack size 88 units), ATC C10BA05, as a result of a formal procurement procedure in accordance with the provisions of Part 4 of the GWB with one or more contracting partners. In order to do justice to the diversity of potential contracting partners within the approval model, during the term of the contract the conclusion of a framework agreement with each pharmaceutical company is made possible at any time and on the same terms.
