DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and, accordingly, the non-discriminatory access possibility for all pharmaceutical companies. It ends automatically, regardless, with the entry into force of the exclusive contract for the active ingredient Ezetimibe + Atorvastatin (excluding pack size 88 units), ATC C10BA05, as a result of a formal procurement procedure in accordance with the provisions of Part 4 of the GWB with one or more contracting parties. In order to do justice to the diversity of potential contracting parties under the admission model, each pharmaceutical company is afforded the opportunity, at any time during the contract term, to enter into a framework agreement under the same conditions.
