DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and hence the non-discriminatory access for all pharmaceutical companies. It automatically ends, regardless, with the entry into force of the exclusive contract for the active substance medicinal product designation CERNEVIT (excluding KPG) and interchangeable FAM, ATC B05XC30 following a formal procurement procedure according to the regulations of Part 4 of the GWB with one or more contracting partners. To take into account the diversity of potential contracting partners within the framework of the approval model, every pharmaceutical company is enabled at any time during the contract period to conclude a framework agreement under the same conditions.
