DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the nondiscriminatory access possibility for all pharmaceutical companies. It automatically ends regardless thereof upon entry into force of the exclusive contract for the active ingredient finished medicinal product designation OLIMEL (excluding electrolyte-free; 7.6%; KPG) and interchangeable FAM, ATC B05BA10, following a formal procurement procedure according to the regulations of Part 4 of the GWB with one or more contracting partners. To accommodate the diversity of potential contracting partners within the approval model framework, every pharmaceutical company is enabled to conclude a framework contract at any time and under the same conditions during the contract term.
