DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the non-discriminatory access for all pharmaceutical companies. It automatically ends regardless upon entry into force of the exclusive contract for the active ingredient finished medicinal product name OLIMEL (except electrolyte-free; 7.6%; KPG) and interchangeable FAM, ATC B05BA10, following a formal award procedure pursuant to the regulations of Part 4 of the GWB with one or more contracting partners. To accommodate the diversity of potential contracting partners within the approval model, every pharmaceutical company is enabled at any time during the contract term to conclude a framework contract under the same conditions.
