TENDER DESCRIPTION

DAK-Gesundheit assumes that this procedure, due to the absence of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies, does not fall within the scope of cartel procurement law. It ends automatically, regardless of this, upon the entry into force of the exclusive contract for the active ingredient Fampridine (exclusively pack size 14 packs and 112 packs), ATC N07XX07, as a result of a formal procurement procedure in accordance with the rules of Part 4 of the GWB with one or more contracting parties. In order to do justice to the diversity of potential contracting parties within the approval model, each pharmaceutical company is, during the term of the contract, allowed to conclude a framework agreement at any time and under the same conditions.
