TENDER DESCRIPTION

DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the non-discriminatory access opportunity for all pharmaceutical companies. It automatically ends regardless upon the entry into force of the exclusivity contract for the active ingredient Formoterol (exclusively IHP in the strength 6 µg), ATC R03AC13, following a formal tender procedure according to the regulations of Part 4 of the GWB with one or more contracting partners. To do justice to the variety of potential contracting partners under the approval model, each pharmaceutical company is enabled to conclude a framework contract at any time during the contract term and under the same conditions.
