TENDER DESCRIPTION

DAK-Gesundheit assumes that, due to the absence of an award decision and the resulting non-discriminatory possibility of access for all pharmaceutical companies, this procedure does not fall within the scope of the cartel procurement law. It ends regardless of this automatically with the entry into force of the exclusive contract for the active ingredient glatiramer acetate (exclusively pre-filled syringes), ATC L03AX13, as a result of a formal tender procedure in accordance with the rules of Part 4 of the GWB with one or more contracting parties. In order to do justice to the diversity of potential contracting parties under the authorisation model, each pharmaceutical company is allowed, at any time during the term of the contract, to conclude a framework contract at any time and under the same conditions.
